The Courts Reflection Part One: Use complete sentences to respond to each of the following questions: 1. Why is the court system so important to the U.S. legal system? Explain. There are various reasons why the court system is crucial to the American legal system. First, we are all equal in the eyes of the law since the court forbids discriminatory treatment. Thus, in a court of law, for instance, if I committed an unlawful act and a president committed the same crime, we would be treated equally. In addition, the courts uphold the checks and balances in our legal system to prevent misuse of authority granted by the US Constitution. The American legal system's courts keep things for the benefit of its citizenry. 2. Which court system level—state or federal—are most Americans likely to interact with? Explain. Many Americans probably are most likely to deal with state courts. A large percentage of Americans deal with state courts whether handling criminal or civil cases. One would deal with federal courts in the case that a federal crime was committed, but the typical American won’t experience that. 3. What powers does the U.S. Supreme Court have? Explain. The highest court in the country is the United States Supreme Court. Their role is legal interpretation. They have the authority to decide whether a proposed law is constitutional, at which point they can either enact it or nullify it. 4. Should judges be elected, appointed, or determined in some other manner? Are you in favor of lifetime appointments for judges? Explain. Judges should be appointed because it is to make sure fair trials by giving judges time to make a fair decision; I am in favor of lifetime appointments because judges are to make decisions that they think are right not decisions that will save their job. Part Two: Now, you be a state trial judge. Read the scenario in the lesson, and then answer the question: Would you find the defendant guilty or not guilty? Explain in at least one complete paragraph. Support your decision using information from the lesson and the scenario. I would not find the defendant guilty in my opinion. The evidence does not indicate that the defendant acknowledged knowing about state laws pertaining to marijuana possession, even though the defendant did not dispute knowing about them either. The state must establish the defendant’s guilt beyond a reasonable doubt for the jury to find him guilty, and I don’t think they have done so in this instance. Every state shall recognize and respect the laws and judicial decisions of every other state. Therefore, the defendant in this instance was right when he informed the officer that his legal rights under Florida law were to be in effect.
