Courts
What They Do
They follow policies. They are accountable for upholding the law and serving the communities around them they live. Sanctuary city law enforcement officers do not cooperate with ICE in order to avoid taking part in immigration enforcement operations.
They draw conclusions about what actually happened in a case. They administer justice in accordance with the rule of law. They are liable to enforce laws and regulations within their authority.
Jurisdictional Issues
Regional and local police departments think they shouldn't embark on the role of the federal government's viewpoint on implementing federal immigration laws because it would deplete their resources, which are already scarce.
The courts in the sanctuary cites are allowed to free illegal immigrants without the need to contact ICE.

When illegal immigrants who engage in criminal acts are sent back to their country of origin, local law enforcement and federal laws and regulations intersect. They both believe that those who have committed criminal acts ought to leave the US. U.S. law enforcement strengthens laws and regulations,
while judicial systems analyze and discipline those who break the law.

State and local law enforcement may be reluctant, or they may reject following federal regulations and laws governing unauthorized immigration. Many sanctuary communities urge their local law enforcement not to check one’s immigration status during an arrest or to keep people in jail after an ICE detainer request.

Identify the functions of law enforcement related to sanctuary cities in the resources provided. What is law enforcement allowed to do, according to Senate Bill 4? What impact or lack thereof has the law had on police operations? Senate Bill 4 bans sanctuary cites in Texas. This permits law enforcement authorities to find out about the immigration status of anyone they apprehend or detain, consisting of routine traffic stops. The Bill does not mandate officers to interrogate individuals about their immigration status, leaving it to the officer's judgment. Senate Bill 4 threatens officials who violate the legislation with imprisonment, monetary penalties, and removal from office.

Identify the functions of court systems related to sanctuary cities in the resources provided. What did this US Court of Appeals for the Fifth Circuit do? What Constitutional issues may arise? The US Court of Appeals for the Fifth Circuit does prohibit some sanctuary cities. This implies that law enforcement personnel may inquire about the immigration status of everyone they arrest or detain. The constitutional concern that may occur because of this, is that it allows for racial profiling and makes both legal and undocumented citizens afraid of voicing a crime or cooperating with police.

Describe how the U.S. law enforcement and court systems relate to sanctuary cities using information from the resources provided. How did they respond to shared issues? What is at least one challenge area for the police in relationship to holding detainees? Law enforcement and the court system are connected. They both must follow rules and procedures, but their first concern is the safety of those in the community in which they work. Local law enforcement in sanctuary communities frequently disregards instructions from federal immigration officials regarding the detainees. According to ICE, releasing illegal immigrants poses a threat to community security since they are not incarcerated. Yet, the constitution may not protect all the cities and communities that withhold information from the government.
