WEEK 1 Discussion
CJL 4048 Chapter 1 Discussion Board: Tracing the Evolution of International Law
Discussion Question 1
Based on the provided excerpts in the chapter, do you think the UK acted appropriately by not storming the Ecuadorian embassy to arrest Julian Assange? Why? Do you think the UK courts are correct in denying Julian Assange’s extradition to the U.S.? Why?
I believe the UK acted appropriately by not arresting Julian Assange. Upon further examination of the UK and US Extradition Treaty. There is a ban on extradition of individuals for political offence. There is a lack of jurisdiction to act of the us request. Julian Assange human rights would have been violated if the UK acted on
behalf of the US government. Code violation include:
1.
United Nations Charter of 1945. 2.
Universal declaration of human rights 3.
American declaration of rights and duties of van 1948
Extradition would have been unjust and oppressive by these reasons alone. the 2003 UK-US treaty requires the denial of extradition if the offence for which extradition is requested is a political offence.
Discussion Question 2
What do you think of the powers of the international institutions on pages 20-21?
Do you think non-state actors, as described on page 22, should have the influence
in lawmaking and enforcement that they have, or do you think that international law should be created via interactions between sovereign states, or through an international organization, such as the United Nations? Why?
The powers and role of international organizations and institutions is to establish a peaceful and harmonic agenda among nation globally. These establishments often mediate, conduct political bargaining, and provide a place for diplomatic programs. and Organizations such as the UN or WHO are considered facilitators
for the alliance development. Cooperation and coordination are essential among nations.
What role do non-state actors play in international law? NSAs have an essential role in the implementation of standards within each nation globally. NSA
monitors the conduct of nations and help them to achieve national and international development goals. AIDS/HIV, Climate change, and Terrorism are issues NSA play a critical role in shaping international law. Each of the mentioned institutions are congruent and needed to establish a harmonic globally plan. Discussion Question 3
In general, do you believe the international issues surrounding Julian Assange have been handled appropriately? Please answer this question through the lens of Chapter 1, section III, and address any relevant conceptual challenges that you think hinder the pursuit of justice. Please note Mr. Assange is still incarcerated in a maximum-security prison in the UK. Do you think Julian Assange has found any justice at all? How?
I think the international issues surrounding Julian Assange has been handled inappropriately the founder of Wikileaks is not the only problem of leaking sensitive government information the real culprits are those turncoat individuals within our government who leaked the information to him. Those individuals should be prosecuted. Julian Assange did release the information and made the U.S. government look incredibly incompetent. It seems as if political officeholders felt that he should be handled publicly while others conducted went without repercussion. He got what he asked for infamy.
