The FBI Internet Crime Complaint Center released an annual report documenting the complaints reported in 2022. There was an increase in phishing and attacks on personal data breach with phishing attacks containing over 300 thousand complaints.
Phishing – This is an illegal act of fraudulently obtaining personal information.
All states have laws in place to prevent obtaining personal information but only a few have specific phishing laws. Furthermore, not all countries have phishing laws, but other criminal laws can be applied to phishing attacks. Identity theft laws covered under 10 U.S.C. Section 1028, HIPPA violations, and fraud, and theft laws can be violated when these crimes occur. Over the last few years, the world has had to conduct a great deal of business online therefore there is great opportunity to be exposed to phishing and data breaching attacks. Based on the increase in phishing attacks, the availability and access to personal data has and will continue to increase the likelihood of ransomware attacks, financial loss, and large data breaches.
