Discussion How does the 4th amendment protect citizens from unreasonable searches? With the fourth amendment, citizens are protected from unreasonable searches in various ways. If one knows he is a criminal or done something wrong, there is need to pay close attention to the fourth amendment because the police will definitely search. However, if one knows he is not a criminal, the amendment protects from unreasonable searches. So as to search an individual, the police have to get a warrant which states why they are searching you, what specifically they will search and where they expect to find what they are searching (Can Police search your Cellphone: ). For example, if one is suspected to have stolen a car, the police cannot go to your kitchen to search for the car because that will be unreasonable search. Does the Fourth Amendment permit police officers to perform a warrantless search of an individual’s cell phone if confiscated at the time of an arrest? Explain why? Yes the fourth amendment allows the police to perform a warrantless search of an individual’s cell phone if confiscated at the time of an arrest. If there is anything that can be used as evidence material such as text messages, the police are free to use them. People have a right against unreasonable searches but this is different when it comes to the time of arrest (Search and Seizure). This is because the police can search your phone, body or even any bags that one has at the time of arrest. This is because one’s cellphone is considered like ones pockets and the police can do a search. How does ‘Digital Forensic Readiness’ Reduces Business Risk? Give several examples.
Digital forensics readiness reduce the cost of digital forensic investigations. At the starting point, there needs to be a breakdown of risks including both internal events those that can be controlled and take place within the boundaries of control e.g. outages, human error and external events those that cannot be controlled and take place outside the boundaries of control e.g. floods, regulations. For example it reduces the effect of cybercrime, it validates the impact of cybercrime or even disputes and it also produces evidence to support organizational disciplinary issues.
