M1A2 Assignment on Historical Memory & Historical Reality The Assignment for Module 1 includes two short-answer questions, but you will pick one of them to answer. Each answer will be worth 5 points and should be 2-3 paragraphs in length. Base your answers on the information presented in the Historical Reality & Historical Memory Sway lesson. Do not use outside sources. Be sure to use specific examples included in our lesson (including the assigned readings and videos). Answer the questions in your own words. You must use the phrasing in the question in your answer. Answer ONE of the following. 1) How did the Supreme Court cases of 1883 (the Civil Rights Cases) and 1896 (Plessy v. Ferguson) allow for the rise of the Jim Crow South with its legal racial discrimination and segregation? Discuss John Marshall Harlan’s reasoning in his dissents for each case. You must include why John Marshall Harlan disagreed with the majority and saw the decisions as being constitutionally wrong. The civil rights cases (1883), and the case Plessy v. Ferguson (1896) allowed for the rise of the Jim Crow South, with its legal racial discrimination and segregation. In Plessy v Ferguson, this was ultimately done by arguing that, under the separate but equal doctrine, it was legal to segregate Homer Plessy. According to the court at the time, it did not violate the 14 th amendment, as long as when separating individuals, the facilities are still equal and fairly accommodating for all. The civil rights cases of 1883 used the argument that the civil rights law of 1875 is to be deemed unconstitutional, as the federal government does not have the authority to restrain racial discrimination under private parties, including businesses. The court ruled in favor of racial discrimination, and segregation for both cases but was later considered wrongly decided. John Marshall Harlan ’s reasoning behind his dissent for the civil rights cases was backed by the 13 th and 14 th amendment. Claiming that the amendments gave congress the power to prohibit private acts of discrimination, because they had public function. He expressed

And disagreed with the majority ’s opinion, insisting that the civil rights act of 1875 was unconstitutional. His reasoning for his dissent in the Plessy v. Ferguson case, was that the separate but equal ” doctrine overstepped the 14 th amendment, because the first section of the amendment granted equality before law. Thus, violating the equal protection clause and concluding the phrase separate but equal was unconstitutional. As you write pay close attention to the requirements below.
