Assignment Two What is the holding in Kyllo? Explain the significance of the fact that the thermal-imaging device is not in "general use." The holding in the case is based on whether or not the thermal-imaging device used on a public street, in order to detect the amount of heat coming from the home, constitutes a search under the Fourth Amendment. There is a warrant required in order to constitute the search. The thermal-imaging device is not in “general use”. The general public would not use the device only a daily basis. The device was used to gather data that was exposed on the outside of the home and thus led to further interpretation to the inside. Discuss the relationship between the Supreme Court rulings in White, Ciraolo, Reiley and Dow with the decision in Kyllo. The relationship between the rulings in White, Ciraolo, Reiley and Dow relates to the decision in Kyllo because in these cases there was a device that was used in order to obtain information that would not be able obtained by the public eye. The device in Kyllo although it was used to obtain information on the outside of the home. That information led to the search and arrest of the individual. These cases all have an impact based on the sole fact that the information that was found by these devices, are what led to what is considered the evidence that proved the suspect guilty. Summarize the argument of the dissent. Do you find the majority opinion or the dissenting opinion more persuassive? The summary of the argument of the dissent is based on the sole fact that the thermal-imaging device did not violate or invade any constitutionally protected interest in privacy based on a variety of different reasons. I find the dissenting opinion more persuasive. I also agree that the device that is used to obtain information on the outside of a home is not a violation of privacy. Describe the steps that the police officers in Kyllo should have taken before using the thermal-imaging device. The officers should have acted with more caution. They should tried to obtain information without the imaging device before actually using the device. Whether it was with utility bills or by other sources. There should have been justification in place and a warrant before they performed the search.
