Employment Discrimination and Safety In this discussion, you will apply three major employment- related laws. A major law in the United States (U.S.) related to providing equal employment opportunity is the Civil Rights Act of 1964. The act prohibits employers from discriminating against individuals because of their race, color, religion, sex, or national origin. Employers may not discriminate in any employment action, such as hiring, firing, or the terms of employment such as pay, working conditions, or privileges of employment. Protection from discrimination based on disability was not covered by the Civil Rights Act. Instead, the Americans with Disabilities Act (ADA) of 1990 protects workers and applicants with disabilities. The U.S. Occupational Safety and Health Administration (OSHA) makes sure the workplace is safe for the public and employees. To help you with your Discussion responses, consult the OSHA learning activity. 1. Two-thirds of accommodations for workers with disabilities cost employers less than $500. Identify at least two ways employers can provide reasonable accommodations to employees with disabilities. Provide examples. 2. What are some advantages to an employer to provide accommodations to workers with disabilities? 3. What are some industries that might be particularly concerned with compliance with OSHA? Why? Providing reasonable accommodations to an employee with disabilities supports the employee’s rights to not be discriminated against as covered by the American with Disabilities Act of 1990 (ADA). There are multiple ways an employer can support these efforts. While this list is not inclusive of all reasonable accommodations, requests can include schedule accommodations, dress code accommodations, providing ergonomic workstations, as well as reserved parking.
Schedule accommodations offer solutions for employees that need more flexibility with the standard expectations for schedule adherence. They can support an employee that needs to take medication at a certain time, nursing mothers that need time to express their milk during their workday and even employees that need flexibility with restroom breaks. Employees that disclose their disability and the need for equipment to support them must be accommodated. The accommodation may be a VARIDESK (sit/stand) desk) or a specific doctor recommended chair. Employers that provide accommodations to employees with disabilities ensure they avoid fines associated with non-compliance to federal law. Employers must remain abreast of laws and regulations governed by the Equal Employment Opportunity Commission (EEOC). In addition, employers that hire candidates with disabilities receive tax credit from the government. In New York State, employers can take advantage of the Work Opportunity Tax Credit and Workers Employer Tax Credit. These employment-based tax credits may save employers money by cutting federal or state tax liability (Workers (With Disabilities) Employment Tax Credit, n.d.). In addition to the fiscal benefits, advantages include promoting a diverse work atmosphere. Employers who focus on promoting diversity Improve decision-making due to diverse backgrounds and perspectives (Barrettroseadm, 2023). The Occupational Safety and Health Administration (OSHA) is responsible for ensuring “safe and healthful working conditions for workers by setting and enforcing standards and by providing training, outreach, education and assistance” ( About OSHA | Occupational Safety and Health Administration , n.d.). Industries whose employees operate heavy machinery are particularly concerned with OSHA requirements. These positions place employees at a higher risk for injury and incident. Additionally, organizations that open their doors to employees and the public, such as retail stores, are also concerned as there is dual responsibility of ensuring the safety of those occupying the space.
