CRIM 101 M07 Assignment – Sentencing Policy Name: Provide answers to the following questions directly on this template. You will upload this document to the M07 Writing Assignment when finished. 1. Define selective incapacitation. Should we consider the dangerousness of the offense before sentencing a person to prison? Does the criminal history of the offender matter even if the person is convicted of a non-violent, less dangerous crime? Selective incapacitation refers to the practice of imprisoning individuals who are believed to be at a high risk of committing future crimes. Advocates of this approach argue that it can help to reduce crime rates while also reducing the overall number of people who are incarcerated. In my opinion, it is important to consider the level of danger posed by an offender before deciding on a prison sentence. Not all cases necessarily require imprisonment. However, I do not believe that a person's background history should be ignored when determining the appropriate response to a non-violent or less serious offense. 2. Using the information on the M07 Incarceration/Incapacitation page, answer the following: Identify the type of state crime most likely to result in a prison sentence in Indiana. The kind of case is most likey to result in prison in Indiana is a drug case Identify the type of federal crime most likely to result in a prison sentence federally. The type of crime that would get you in jail in Indiana is a drug case 3. Discuss ways in which we can use a selective incapacitation model to reduce facility overcrowding. Selective incapacitation involves selectively choosing which offenders to incarcerate, aiming to address and alleviate prison overcrowding. This approach does not include mandatory minimum sentences, which contribute to prison population growth and overcrowding. 4. If we determine less dangerous offenses should not receive prison or jail time, what is the alternative? Refer to Chapter 10 and community-based supervision. Is something else more
