In it’s simplest form, it means to ‘take care’. Due diligence is to take every reasonable precaution, in any given circumstance, to protect the health, safety and welfare of yourself and the people you work with. Requirements include all workers must understand and carry out their legal duties, assess the risk and hazards in the workplace on an ongoing basis, and take all reasonable precautions with respect to those risks. Access the Occupational Health and Safety Act 2004. What Section deals with the way in which employers must be consulted? Section 35 & 36 the OHS Act 2004 provides for ‘duty of employers to consult’ and regulation 21 of the Occupational Health and Safety Regulations 2017 (OHS Regulations) provide for ‘how to involve Health and Safety Representatives (HSRs) in consultation’. This requires a two-way exchance to share WHS information, give employees the opportunity to express their views and provide their suggestions, along with using the input of employees in policy and procedure development b. What are the main points of this Section? Employers must consult with health and safety matters in the workplace. HSRs facilitate communication and consultation. They provide a crucial link between employers and employees and can help achieve better health and safety outcomes in the workplace. The hierarchy of control consists of three levels of control measures that aim to eliminate hazards and manage risk. Safe design is about integrating hazard identification and risk assessment methods early in the desing process, to eliminate or minimise risks of injury throughout the life of a product. This applies to buildings, structures, equipment and vehicles. It is a systemativ process of hazard identification and risk assessment during a product or job design process. Question 13: a. What is the role of a designated work group? Negotiated and agreed group of workers sharing similar WHS interests and conditions. They are not essential to set up DWGs but may be established by an employer and may be requested by a worker. DWG must have at least one Health and Safety Representative (HSR) who is elected by the DWG. b. What is the role of a health and safety representative? Health and safety representatives (HSR) are trained in WHS and how to represent the DWG. They represent the DWG in raising issues with employer. They have rights and power to take action on DWG behalf, and participated in issue resolutions. HSRs also pass information back to workers. Question 14 Jemima injured her arm at work when she tripped on the walkway at work. Jemima has put in an incident report. What should Jemima’s manager do with the report? The employer is required to investigate any injuries, illnesses or near misses that occur in the workplace. This can allow for hazards and risks to be identified and for measures put in place to prevent further incidents. Jemima’s manager must find the cause of the incident, put in place corrective actions (such as immediate actions, changes to policies and procedures, retraining and planned process). Jemima’s employer is only required to report the incident to the Worksafe authority in the case of death or serious injury or illness.
