Victoria Miles April 21, 2023 Portfolio Project Final 120 Bryant & Stratton College To: Attorney Max Justice From: Victoria Miles (Bryant & Stratton College) Re: Potential Client Jessie Rider With the information provided from our potential client Jessie Rider this would be a civil case filed in state court. Although during transport they were passing through state jurisdictions it will fall on the state that the injuries took place in. There are no federal laws being broken or any type of federal involvement. Ms. Rider could potentially sue both Bess Driver, driver for the shuttle bus and Ron Renter, the driver for WE-HAUL-IT-ALL, for the involvement of her injuries. Both drivers could potentially be held liable due to reckless driving resulting in Ms. Riders injuries that she sustained while in transport. Even though both drivers have yet to be charged with any type of tickets they both can be held responsible for the injuries Ms. Rider sustained during this time. In conclusion, Ms. Rider has a solid case with a high chance of winning this case. The only information I feel I’m missing here is how many others were on the bus at the time of the incident? Were any other party’s injured as a result of this accident? Are there any witnesses to the accident that the police have a report from? What caused the bus shuttle to run off the road? Are there any bystanders that witnessed this? Once we have answers to the questions above will determine whether or not we have any other witnesses for this potential case and we will be able to move to the next step for this case.
memo The Justice Firm To: Supervising Attorney From: Victoria Miles Date: April 2, 2023 Re: Discovery Questions for Jessie Rider’s Case against Truck Driver Ron Renter On July 4 th , 2022, there was a vehicle accident involving Jessie River who was a passenger on a bus traveling to Washington DC to celebrate Independence Day at the national mall. There was a vehicle accident involving the bus Ms. Rider was on and a truck Ron Renter rented from We- Haul-It-All. Ms. Rider was injured during this incident with a sprained wrist. Upon moving on with this case I would like to prepare a written discovery upon trial. There will be several discoveries within this case that I would like to be brought to your attention awaiting trial. Interrogatories is a written discovery where I will type up several questions that must be answered in a written response these are general questions based on factual information which cannot be used to draw a legal conclusion. How did the accident occur? Do you suffer from any medical or mental health issues prior to this incident? Were you asked to take a field sobriety test at the time of the incident? Request for production is a written discovery used to gain access to documents. The aim is to gain insight into any relevant evidence that may factor into the case. Vehicle Insurance documentation Most recent physical from your physician
Any photos that you may have taken at the scene of the accident. Admissions is part if the written discovery that allows one party to request that another party admit or deny the truth of a statement under oath. Were you intoxicated at the time of this incident? Was there anything clouding your mind at the time of this incident? Did you lose control of your truck causing part of the accident to occur? Upon reading these written discoveries once we have received the appropriate requests back, we will have a clearer insight and can move on with proceeding this case. It will help clear things up for the case on what took place on the day of the accident.
