With the upcoming collaboration between Helios and Fit-Advantage there will be pros and cons for the companies that could either destroy or push both companies forward. The main issue that has been raised by this collab is that Fit-Advantage will have to give Helios their customers’ information which goes against their policy. Fit-Advantage going against their own policy that each one of their customers has agreed to could potentially hurt the company. Giving up personal data without consent goes against HIPPA and COPPA laws that have been established to combat these particular actions. The Health Insurance Portability and Accountability Act (HIPPA) was established in 1996 and it required the Secretary of the U.S. Department of Health and Human Services (HHS) to create regulations to protect the privacy and security of certain health information. Fit-Advantage will be going against this law if they give up their customers’ information with their collaboration. If any of their customers find out about this happening, then they will have all the authority to initiate a lawsuit against the company. That one single lawsuit could prove to be the demise of Fit-Advantage. COPPA or the Children's Online Privacy Protection Act protects children’s information from being used, collected, or disclosed across the internet. Since there are children that are signing up for Fit-Advantage they will need their parents (if they’re below the age of 13) to sign up for them and give the company consent to collect their child’s data/information. Once again Fit- Advantage will be going against another law that can get them into a heap of trouble with potential lawsuits from the parents of the children that have made an account on their website. The pros of this collab will be the advertising of the deal Fit-Advantage will have through Helios’s subscription that will most likely result in a lucrative outcome due to the number of people that will be enticed by the discounted deal. This pro still will not outweigh the huge
shadow coming from the data consent problem Fit-Advantage will have to deal with. This problem could be fixed if Fit-Advantage puts out a statement for their customers that will state that they will be giving away their data and information in return for a discounted Fit-Advantage plan. But if there isn’t a public statement or message coming from the company then I would not get involved with a collab with Helios.
