Explanation of Solution

Cholera is a serious water-borne disease that is caused by Vibrio cholera. The bacterium is a spiral bacterium that is gram-negative and present in contaminated food and water. The bacteria stick to the lining of the gastrointestinal tract and multiply within the host. The symptoms of the disease are due to the production of a toxin known as ‘cholera toxin’, which belongs to the class of enterotoxin (affecting enteric or GI system).

The typhoid fever is caused by Salmonella enterica serovar typhi and is contracted through the ingestion of contaminated food or water. This can also be contracted from the feces of infected human or human-to-human contact.

Hepatitis A is spread from eating or drinking contaminated food that contains a small amount of virus transferred from fecal matter. Hepatitis B is spread through sexual contact or intravenous drug use, whereas Hepatitis C is only spread through direct blood transfer. The demarcating feature for hepatitis C that is different from hepatitis A and B is that hepatitis A and B can be treated by a vaccine that helps to prevent the disease and medication can cure the ailment.

A negligence action was brought by a mother against a hospital on behalf of her minor daughter. It alleged that when the mother was 13 years of age, the hospital negligently transfused her with Rh-positive blood. The mother's Rh-negative blood was incompatible with and sensitized by the Rh-positive blood. The mother discovered her condition 8 years later during a routine blood screening ordered by her healthcare provider in the course of prenatal care. The resulting sensitization of the mother's blood allegedly caused damage to the fetus, resulting in physical defects and premature birth. Did a patient relationship with the transfusing hospital exist?
