STATE POWERS 2
Introduction Gun laws have been a controversial topic for many years. Many people believe it
is their God-given right to bear arms and protect themselves from any form of danger.
Others believe there needs to be a ban on guns due to the high risk of mortality rate and
misuse. In this paper we will compare and contrast the difference between laws that
regulate gun usage, the constitutional right that gives people the power to bear arms,
and how this overall affects the people.
Compare and Contrast
According to Greenberg (2018), each state has its own political culture that is
affected by public opinion or the culture. Each state creates its state constitution which
caters to public opinion. However, every state must follow the federal constitution (

. Under federal law, everyone has the right to bear arms.
This protects people nationwide to always be able to carry a gun. Under this law, every
state has to give people the freedom to be able to carry and cannot take this away.
Although the 2
nd
Amendment is set in stone and can not be diminished Congress
created the necessary and proper clause, which allows Congress to enact laws that are
deemed as proper and necessary that are not specifically stated in the US Constitution
but can be implied. This allows Congress to be able to add to the U.S. Constitution that
doesn't particularly take away the right to bear arms but adds laws that enhance the
regulations on guns. According to Overview of Necessary and Proper Clause |
