Case Study # 1 Facts
J.W. Gamble, a prisoner in the Texas detention structure, was at the center of the present incident. A massive cotton bundle considering more than 500 pounds collapsed right on the surface of him in late 1973 (M Ross, 2012 ) when he was employed at a weaving factory. The incident left him with several ailments, including a serious lower back condition. When the jail's physicians first tried to determine if he had a herniated disc, they came to the conclusion that he didn't. They thus gave Gamble some medication and allowed him to resume his job. Unfortunately, the pain persisted, and in spite
of several appeals, he would not go back to work. Because of his stubbornness, the prison authorities chose to put him in isolated circumstances and chastise them (J.South, 2012) Gamble filed a pro se lawsuit afterwards, claiming he was subjected to unfair and unusual treatment, thus after seeing his health had declined. On appeal, the Fifth Circuit Court of Appeals reversed the district court's the dismissal of his suit. The Fifth Circuit acknowledged in its ruling that the prisoner was misdiagnosed and did not get therapy, and that his problems were made worse by being kept in solitary confinement. Certiorari was granted by the Supreme Court when the government of Texas filed a petition for review. ISSUE Firstly, did Gamble establish a claim that may lead to relief—that is, a constitutional question—while arguing that he was the victim of unfair and disproportionate repercussions? Secondly, was it right for the Fifth Circuit to reverse the district court's decision to deny Gamble's case? Examining The facts and the specific complaints of the accused are thoroughly examined by the Court in its consideration of the present case. As said at the
beginning, throughout the course of a few months inside jail, Gamble received medical attention over a dozen times (Taylor & Francis, 2017). Moreover, it said that if he received any inadequate treatment, it may have
been accidental or merely careless—a determination that his attending physicians should determine. Still, it did proceed with setting up
