1 Since the director is a friend of the physician and knows he should have been more specific in his documentation, should the HIM director allow the physician access to the record to add the documentation? Justify your response. Regardless of the friendship between the director and the physician, the director should not allow the physician to access the record to add documentation. This is strictly because the record has been placed on legal hold. “A legal hold basically suspends the processing or destruction of paper or electronic records” (Brodnik et al., 2017). Legal holds are issued by the court if there is concern information may be tampered with or destroyed. “The hold notice should be written in layman’s terms and should include a list of documents to retain and instructions on how the documents will be collected” (Ogrosky & Shuren, 2020). Therefore, the physician cannot do anything with the patients’ records. Also, it is the HIM directors’ responsibility to follow standard ethics by ensuring the patient’s record is safe and out of harms way until further notice. If the HIM director did give the physician access to the record, what ethical issues does this decision raise? If the HIM director gave the physician access to the record, the HIM director would be breaking the law and that could potentially lead to serious consequences. Altering a medical record indicates the staff manipulated the evidence and such proof can destroy the hospital’s credibility. This decision raised ethical issues such as respecting the law and upholding the standards of professionalism and being honest in all situations. The HIM professional did not safeguard the confidentiality of patient health records nor did they put service and the health and welfare of the patient before company-interest.
