A band called Play Cold releases an album in the U.S. of ten new original songs. The
copyright for each song ever composed by Play Cold is owned by ABC Music
Publishing Group. Miguel listens to the entire album and decides he will record his
version of what he just heard on Play Cold's album for his upcoming album.
Assignment Questions
A. Can Miguel go to the U.S. Copyright Office and get a compulsory
mechanical license granting him permission to record a version of all ten
songs? Why or why not?
(6 points total: 2 points for discussion of each
criterion)
Miguel can get a license to perform a version of Play Cold’s songs. Play Cold’s
Album was distributed to the public in the U.S. The album Miguel wants to cover is
also a non-dramatic musical work. Since ABC Music Publishing Group owns the right
to grant a license, it would be best for Miguel to go directly to them.
From my own experience releasing covers of other songs to streaming platforms,
you can now request this license remotely and be approved within a few day’s time.
Many music distribution platforms like Distrokid also make this process very easy.
Once granted the license, Miguel will need to give a percentage of the royalties to
ABC Music Publishing Group.
B. If Miguel records his version of any of the songs on Play Cold's new
album, please explain why either Miguel, Play Cold or ABC Music
Publishing Group would be the proper owner of Miguel's recordings.

Miguel is the rightful owner to his own recordings. ABC Music Publishing Group can
acquire the rights to Miguel’s song through a mechanical license agreement. Miguel
can move forward while adhering to the terms in the mechanical license agreement,
and pay a percentage of royalties to ABC Music Publishing Group. A distribution
platform can additionally help deduct the legally mandated fee from Miguel’s
earnings and pay the original songwriter automatically.
