MEMO To : Don Washington, Director of Marketing, Rewards Membership Alva Ramirez, Director of Sales, Rewards Membership Anne Hernandez, CEO From : Christian Valdez Subject : Addressing Legal Team Concerns on Low-Income Marketing and Sales Plan Executive Summary We appreciate the input from the legal team regarding our rewards membership program. Their concerns were Data collection and privacy, and truth in advertising. The legal has asked us to come up with a solution to follow the requirements of the U.S. Federal Trade Commission when reaching out to different demographics for our rewards program. Also Respecting the Data Collection of underage youth for our high school rewards program. Addressing One Legal Issue In our rewards program that involves high school youth we are confronted with the legal issue of data collection and privacy when it involves under the age of 18 members.
Addressing One Ethical Issue An ethical issue that is faced is the marketing of our rewards program to low-income communities and how we can comply with legal and ethical guidelines to avoid targeting the diverse groups within the consumers in this community. Providing a recommendation For the first legal issue that states the hurdle we face of data collection and respecting privacy especially amongst our underage customers, particularly our high school rewards program. It is also important to note that high-school aged youths are one of our biggest customers. The solution is that we propose a privacy policy worksheet that complies COPPA that requires parents’ consent before collection personal information for children under the age of 13 and for high school students, we must follow ethical guidelines that respect their privacy as well as getting their parents’ consent. As well as providing transparent information about the data we will collect and following laws and regulations to the state and community they come from. Addressing the ethical issues is another hurdle we must cross and the ethical issue that we got from the legal teams response is how we market our rewards program to low-income communities and how we cannot target certain demographics within communities and being aware of the diversity in low-income communities. Our solution to this issue is to be clear and precise that we are not solely seeking financial gain but to also give back to their communities. We will work with our marketing department and consumers to identify what areas consumers would want to improve in their community. It is also
important that the marketing department is transparent with their guidelines and fees found in the rewards program offered to low-income communities.
