THE TERM “PLEADING”
a.
Definition - Pleadings are the various documents that describe the claims and
defenses of a lawsuit, including the complaint and the answer to the complaint.[1]
b.
Pleadings are official written documents that are filed with the court as part of a
civil lawsuit. They explain the basic situations of the plaintiff and defendant and
the facts that support their claims or defenses. Pleadings provide notice to the
parties of the issues that need to be resolved. Pleadings are also public records
unless ordered sealed by the court. Each jurisdiction gives a specific layout of
how and when these documents should be filed, when the defendant should give
an answer, and how these documents should be formatted.
The most common
pleadings are complaint, answer, and counterclaim.[2]
c.
The filing of a
complaint
, or petition,
marks the beginning of a lawsuit. In the
complaint, the plaintiff outlines his version of the facts of the argument, states the
legal foundation of the lawsuit, and tells the court what compensation he is
seeking. The defendant’s response to the complaint is known as an
answer
. This
is when the defendant addresses each topic in the complaint and states his version
of the facts of the dispute. Once a defendant has been served with a complaint, he
has a specified period of time in which to file an answer. The defendant may also
file a
counterclaim
describing why the plaintiff was at fault, what damages he
has suffered, and what compensation he is seeking in return.[3]
