Do we need the Expert? The reading was interesting to me because I did learn some new information about court procedures, testimonies, and opinions that do and do not matter. What I learned new from the studies was that police witness interview can be admissible in court, and that testimony of the witness can replace a document. Previous belief I thought that police witness could never be admissible unless they were irrelevant to the case. That experts can give their opinion in court, while lay witnesses are not because they have no knowledge or expertise to anything reliant to the case. I believe all witnesses could give their opinion about the defendant. Also, I learned the difference between reliable and relevant facts in a case. Reliable facts make a fact probable, while relevant facts must be real and not tampered with at any point. In the case of Shanynthia Gardner’s case, there was a lot of information that was reliable facts, but there was relevant evidence. Reliable facts make a fact probable, while relevant facts must be real and not tampered with. The reliable facts where Mrs. Gardner has a sever mental illness and has for some years now. There are records and testimony from experts that have conferred her condition. Then there is the Prosecutor saying that she committed these murders because of her baby’s daddy. Yes, she accused him of cheating all the time but never no hard evidence of an affair ever existing between her husband and another woman. The expert in this case was Dr Wyatt Nichols who has practiced for 41 years as a Psychologist, Behavioral Health Social Service. We would need this doctor because he is the doctor that treated the defendant after the crimes were committed. He agrees that Mrs.
Gardner has a severe mental illness and can describe the defendant state of mind at the time of the murders. Therefore, this testimony would be a positive statement for the Defendant.
