Carla Taylor will be representing the Defendant Shanynthia Gardner
Shanynthia Gardner is charged with stabbing her four children to death, do to her severe mental illness.
Physical Evidence:
I would like to make an appointment to speak with investigators and the Officer that was present
at the time of Mrs. Gardner’s arrest. I would like to have the video from the back of the patrol car
when the defendant was arrested
(Ct. App. April 4, 2023).
I would have to file a request in person or by e-mail to the The Memphis Police Department in the Central Records Department. I will request and pick the video up myself to bring to court for evidence on behalf of Mrs. Gardner. I would have to file a subpoena duces tecum with the court clerk to get Detective Crews to court. Documents for Evidence:
The documents that I would like to submit are Mrs. Gardner’s mental records from Memphis Mental Health Institute. Will have to get the defendant Shanythia Gardner to sign a HIPAA for their release of the medical records. Mrs. Gardner will also have to sign an Authorization to Release Confidential Information Form. Carla Taylor will get forms signed and go to the Memphis Mental Health Institute with the signed forms and obtain the records. I would have to file a subpoena and serve it to Dr. Wyatt Nichols, who is the Clinical Psychologist at Memphis Mental Health Institution and the records for Shanythia Gardner
(Ct. App. April 4, 2023).
Name a witness to come to court:
I would ask Ashley Snodgrass to come to court. She is the defendant’s sister. Ms. Snodgrass was in contact with the defendant prior to the day of crime and the day of the crime. I would file a subpoena with the clerk and have her served in her city and county where Mrs. Ashley lives for Ashley Snodgrass to be in court. Talk with her to tell her that her sister needs treatment for her illness not to just be locked up. I would also offer her a ride to town to be able to attend court on her sister’s behalf.
