Rice 2 Writing Assignment #1 Question 1 State the elements of the statute Carole Bond was convicted of violating. Answer: Carol Bond was convicted of violating Section 229 , purposely used a "chemical weapon. Bond's attempt to hurt Haynes was not nonviolent; according to the law, Bond sprayed "toxic chemicals" on Haynes' home and car. Question 2 List all of Carole Bond’s acts and her intent relevant to deciding each of the elements of the crime. Answer: Carole Bond’s stole 10-chloro-10H-phenoxarsine, a chemical with an arsenic base, from her job. Instead of killing Haynes, she preferred to give her a rash. She placed an Amazon purchase for a vial of potassium dichromate, which is used to clean lab equipment. Both substances are fatal to people. So that she could injure Haynes, Bond visited her home twenty-
four times and spread chemicals throughout it. Haynes suffered a chemical burn, but medical attention was given right away.
Question 3 Do you believe she violated the statue? Defend your answer. Answer: I believe she did because she purchased potentially lethal chemicals. Given what had transpired
with Haynes, she took this action while understanding that it would be harmful. Question 4 Do you agree that Bond doesn’t belong in prison for a chemical weapons offense? Explain your
answer. Answer:
Rice 3 I agree that Bond doesn’t belong in prison although she didn't want to intend the unborn child or kill Haynes on purpose, she nonetheless belongs in prison and should receive a lighter sentence because she did attempt to exact revenge on Haynes for having an affair with her husband and having a kid with him. Question 5. Who decided to charge Bond with the minor state offense of harassing phone calls and letters instead of the more serious federal chemical weapons offense? According to the Court who should decide? Do you agree? Disagree? Explain your answer. Answer: This person decided The United States Congress, the authority of the police. Since Bond's only intention was to bother Haynes rather than utilize the chemicals as a lethal weapon, I agree with this charge. Was she in the right mindset though? Not at all.
Question 6 Do you believe this case represents an example of federal government overcriminalization?
(Review the discussion on page 17 of our text.) Answer: I believe it shows certain aspects of the case were handled too brutally and others not hard enough, it demonstrates federal overcriminalization.
Question 7 In your opinion, does this statute violate the place of criminal law in our federal system of government? Explain. Answer: In my opinion no, it does not break any laws, even if Bond only intended to irritate Haynes skin, things could have been very severe in this situation had Bond accidentally killed her.
