person accused of an offense is presumed innocent until proven guilty beyond a reasonable doubt, and the burden of proof for all elements of the offense is upon the prosecution.

In the context of law enforcement, what is “qualified immunity?”
designed to protect all but the plainly incompetent or those who knowingly violate the law. Law enforcement officers are entitled to qualified immunity when their actions do not violate a
clearly established statutory or constitutional right.
