Case C2: Ellasaurus Products Enterprises. 1. Ellen will use some copyrighted illustrations from her books on the Web site. She will also include themes from the story lines of her books in some of the games that will be available (free) on the site to registered visitors. Prepare a report of about 300 words in which you discuss at least two intellectual property issues that might arise in the operation of the Web site. Intellectual properties are tangible or intangible products of the human mind. Intellectual property rights include protections afforded to individuals and companies by government through governments’ granting copyrights and patents, and through registration of trademarks and service marks (Schneider, 2017). Ellen intends on using her copyrighted illustrations onto her website. An intellectual property issue that might arise from using her illustrations is the potential for outside entities to use her copyrighted illustrations for their own personal use. Copyright is granted by the government to the author for a literary or artistic work (Schneider, 2017). When a copyrighted material is located on the Web, it is an easy target for copyright infringement due to the easy access to the content. Ellen will have to understand and monitor the usage of her illustrations and the potential to be fair use. Fair use is the usage of copyrighted material in specific restricted ways in criticism, comment, news reporting, teaching, scholarship, or research (Schneider, 2017). Therefore, there can be a potential for her illustrations to be used outside of her website in ways that do not infringe copyright law.
Trademark issues are another possible intellectual property issue that may arise. A trademark is a distinctive mark, devise, motto, or implement that a company affixes to the goods it produces for identification and purposes (Schneider, 2017). Two issues that can arise for Ellen is the possibility that the publishing company for her books owns the rights and has trademarked Ellasaurus or the usage of Ellasaurus illustrations for products outside of the book. The second issue that may arise is while she visited sites like Hello Kitty and Nick Jr., she would have to ensure that the layout of her web site and web design does not infringe on any trademarked design of those two sites. 2. Children are using smartphones and tablet devices at increasingly younger ages today. In about 100 words, outline the type of mobile app or apps that might work for Ellen. Ellen could potentially face ethical dilemmas trying to specifically outreach to children though visiting and allowing purchases on her website. There is a potential however for Ellen to spark the interest of children wanting to purchase her merchandise by using the app Epic as a platform to for children to have access to read the Ellasaurus book. Epic is the world’s largest digital library for kids. It’s a kid-safe, interactive reading app where kids have instant access to over 40,000 books, audiobooks, and learning videos (Epic Creations, 2013). Listing her book on this platform can potentially build the popularity of the book and be free advertising for the merchandise.
3. In about 200 words, describe the ethical issues that Ellen faces because of the ages of her intended audience members. Be sure to deal specifically with advertising issues as well as issues that might arise in managing the virtual community elements of the Web site. Ethics is not only about the values people hold and act upon, but also about examining and analyzing several principled beliefs and customs that set the underpinning for judging specific norms or behaviors (September, et. Al, 2021). In e- commerce online businesses must find ways to ensure that the business is meeting all ethical standards, and those standards are taken into consideration when making policy decisions. Online businesses have the ethical duty to ensure information such as personal identifiable information, emails, and the communication of that information is well protected against breaching and sharing with unauthorized parties. This is especially important with web sites that attract children, which is the type of website that Ellen will create. Children are less able to make informed decisions (Schneider, 2017) therefore Ellen would have to ensure that there are privacy statements are in place for the protection of information and that parents only have the ability purchase the merchandise. If she allows the storing of credit card information when conducting a purchase, she will also have to ensure that there are multiple identifiers to prove that the purchaser is the parent and not the child. Ellen would also have to put into consideration the type of social correspondence that the children will be able to have on the website to protect the children from conducting online conversations with potential predators.
