UNDERSTANDING AND SUPPORTING INDIVIDUALS WITH DISABILITIES IN THE
CRIMINAL JUSTICE SYSTEM
1. Description of the Population
People with disabilities represent a
very large and diverse part of the world's
population, ranging from varied physical,
sensory, intellectual and mental health
conditions. Disabilities can be physical, such
as mobility impairments, and non-physical,
such as mental health disorders (Gulati et al.
(2020). This group includes people from all
age groups and backgrounds, and these
individuals more often have to deal with
many difficulties that make the criminal
justice system more challenging to them.
2. Risk Factors Related to the Criminal Justice System
Disproportionate Incarceration and
Victimization:
Studies show that persons with disabilities are more prevalent in the
criminal justice system than the population, both as offenders and crime victims (Leotti &
Slayter, 2022). They are frequently victims of suspicion because of systemic
discriminatory biases or of interpretation of non-customary behavior by police and the
lack of legal aid accessible to them that is focused on their needs.
Communication Barriers:
The significance of effective communication in the national
context for many disabled individuals who go through the criminal justice system cannot
be underestimated. These hearing, speaking or cognitively impaired individuals might
find it even more impossible to articulate their needs or follow the legal process
(Blackmore et al., 2022). This barrier can be very detrimental to an individual's defense
in court and all contacts with police personnel and those in the correctional service
system.
Vulnerability to Abuse:
Inside correctional facilities, people with a disability are easier
to inflict with abuse and to be neglected. The absence of required and overall absence of
knowledge about disability rights among inmates and personnel creates a vulnerability
factor for them (Blackmore et al., 2022). This issue is compounded by the fact that these
obstacles, such as architectural and physical barriers, impede their safety while around
these locations.
Mental Health Challenges:
The stress factors of arrest, confinement, and the instability
and uncertainty of legal proceedings can cause a deterioration of mental health conditions
(Leotti & Slayter, 2022). Criminal justice frequently has an insufficient infrastructure to
give mental health care that is crucial for dealing with stress and cutting down the
chances of reoffending.
