Russia's Federal Security Services (FSB) claimed that Apple collaborated closely with
US intelligence agencies to breach hundreds of iPhones owned by Russian consumers and
foreign diplomats in the cybercrime incident I selected for my project. They surmise that the
infections began with an unread iMessage attachments, a vector that rivals that sell to foreign
government agencies and Pegasus spyware seller NSO Group also utilize. Taking a look at the
matter, Russia's Federal Security Service said, without offering any proof, that thousands of
iPhones in the nation had been compromised in a recently uncovered espionage effort that it
linked to the US government. “Russian cybersecurity company Kaspersky Lab said the campaign
had implanted file-stealing malware on iPhones of its employees who were running a year-old
version of Apple’s mobile operating system, adding that it did not have enough evidence to
blame any government or group for the breaches.”

The federal Computer Fraud and Abuse Act ("CFAA"), 18 U.S.C. § 1030, and the Stored
Communications Act (Title II of the ECPA), 18 U.S.C. § 2702, govern the legal process for this
crime. It is illegal to willfully gain unauthorized access to, or use more access than is permitted
to, a facility that provides an electronic communications service ("ECS"), which could include,
among other things, email service providers or even email provided by employers (Global Legal
Group, n.d. Because it has both local and foreign jurisdiction, the CyD would be the division
handling this matter. The operation, according to Russian cybersecurity company Kaspersky Lab,
was responsible for installing file-stealing malware on staff members' iPhones running out-of-
date versions of Apple's mobile operating system. Thanks to Kaspersky Lab, Apple has
addressed two recently identified security vulnerabilities in its iPhones and iPads that were being
used to compromise thousands of devices in Russia. The business went on to say that there
wasn't enough evidence to link the breaches to a specific government agency or group. “Apple
denied that charge, with a spokesperson proclaiming: “We have never worked with any
government to insert a backdoor into any Apple product and never will.”
