Case 2-24. Security Measures for Access to Protected Health Information
Your healthcare organization recently had a privacy violation. Terry, a former
employee, was terminated six weeks ago. Apparently, Terry held a grudge against
the hospital for firing him, so he logged into the radiology information system,
downloaded PHI from 1,000 patients, and then posted the information on his
personal website.
One of the current employees, Sean, who knew Terry, just happened to visit
Terry’s website to see if it said what he was doing now. Sean saw an inflammatory
story about the hospital and some PHI posted on Terry’s website. Sean
immediately reported the breach to the healthcare organization’s privacy and
security officers.
What are the legal issues involved in

Case 2-36. Contingency Planning
You work in a healthcare organization that was affected by a recent flood. You
were more fortunate than most because only your basement was flooded. The
problem is that the data center was in the basement. The data on the computers
has been completely lost because the computers were destroyed. Unfortunately,
the back-up tapes were located in the room next to the data center and were also
destroyed.
Fortunately, the HIM department, is on the second floor and the health records
are intact. Although the lab, radiology, dictated reports, and nursing notes were
electronic, the reports had been printed out and filed in the health record. The
HIM director has been trying for a year to get the information system department
to develop a contingency plan because of the CFO’s decision to stop filing the
reports that are stored electronically. The information system staff had not
recognized the need for the contingency plan, but the flood was the catalyst that
convinced them.
What should be done to ensure that
the healthcare organization will not
