Amendment: The Fourth Amendment
Summary: In 100–150 words, summarize the amendment you chose. Be sure your summary includes all rights given to citizens in that particular amendment.
Summary: The Fourth Amendment protects the American citizen against the illegal search and
seizure of the person. The right to feel secure in their persons or home, or papers. Protects against unlawful search and seizure. One shall not be violated or no warrants to be issued, but with probable cause or with the support of oath or with affirmation. A warrant that is issued must particularly describe the place to be searched as well as the persons and things to be seized. Officer obtaining the search warrant must prove that there is probable cause for said warrant. If probable cause is not proven, then the warrant will not be issued. The judge will have final discrepancy if the warrant will be issued or not. Citizens’ Rights: Identify a real-world example of where citizens’ rights under the Bill of Rights may not be guaranteed. (Clearly explain where
citizens’ rights could conflict with the intention of criminal justice professionals to ensure safety.)

Katz appealed the United States after the Unites States charged him with illegal betting. Kats was a sports bettor and regularly used a public phone booth to transmit his gambling handicaps. The FBI used recordings from the public phone booth to prosecute them. The rights of a citizen may not be guaranteed because the pay phone is a public area, it is not a personal item nor is it one personal place. Anyone has access to this pay phone. Katz argument is that the state did not have a warrant to use his calls to prosecute him.

Professionals: 1.
If an officer sees people going in and out of a house, and he suspects that there is suspicious activity happening. He cannot take it upon himself to search the suspicious property. If an officer was to search property and find evidence, that evidence would not stand in court because there was no search warrant issued for property. 2.
If law enforcement personnel request a search warrant, they must provide and prove the
probable cause. If it is not proven or substantial, the judge will not issue one. 3.
When an officer pulls over a vehicle, and officer walks up to the window and the driver
is acting a way that the officer doesn’t like, that does not give him probable cause and cannot search the vehicle based on not liking the drivers demeanor.
