BUSI2023: Business Law LA1 Avantika Yadav I work in a restaurant where adhering to a number of federal, provincial, and local laws as well as company standards is required. I had to complete a few legal forms, attend training sessions, and complete a few online courses relating to food safety even before I joined. Occupational Standards: Federal: For sectors that are subject to federal regulation, such as transportation, the Canada Labour Code establishes criteria for employment, including work schedules, overtime pay, and statutory holidays. Provincial: In Ontario, the Employment Standards Act regulates issues including the minimum wage, the number of hours worked, overtime pay, and vacation time for the majority of employees. Safety and Health at Work: Federal: Health and safety requirements for federal workplaces are outlined in Part II of the Canada Labour Code. Provincial: In Ontario, workplace safety is covered under the Occupational Health and Safety Act, which also addresses training, tools, and accident reporting. Municipal regulations Municipal regulations, such as noise limitation, and waste management, that the restaurant must abide with. Employees and organizations must routinely review legal materials, governmental websites, and trade associations to be informed of advancements in applicable law if they are to keep up with the firm and its legal obligations. Participate in legal compliance seminars and training sessions, and consult with an attorney for guidance and updates. Many restaurants have internal rules that staff members must abide by regarding cleanliness, appropriate attire, providing excellent customer service, and workplace behaviour. To keep a great working atmosphere and provide great customer service, compliance with these additional regulations is essential. A formal legal procedure through the courts is litigation. It can be expensive and time- consuming. involves a judge who is ordinarily chosen by the court to render a decision in
accordance with the law and accepted norms and mandatory involvement if legal action has been taken. Negotiation, mediation, and arbitration are all parts of the Alternative Dispute Resolution (ADR) process. involves having an impartial third party, chosen or agreed upon by all parties, participate in order to assist the participants' conversations and negotiations. In the business, disputes can occur with suppliers, customers, employees, and other stakeholders. I think ADR might perform better in the setting of a business like a restaurant for a few reasons. Relationships with suppliers, customers, and workers may be maintained and can be less combative when ADR is used. The requirements and desires of the parties involved can be catered to in ADR proceedings. helps participants understand the real issues and the root of the conflict through direct discussion in a non-confrontational environment. Additionally, discussions and documents are all kept confidential unless otherwise compelled by law. This may help to preserve the restaurant's reputation. References: Branch, L.S.
