36-6-106 (8): The moral, physical, mental, and emotional fitness of each parent as it relates to their ability to parent the child. The court may order an examination of a party under Rule 35 of the Tennessee Rules of Civil Procedure and, if necessary for the conduct of the proceedings, order the disclosure of confidential mental health information of a party under § 33-3-105(3). 37-1-128 (E1A): If, during the pendency of any proceeding under this chapter, there is reason to believe that the child may have a mental illness, the court may order the child to be evaluated on an outpatient basis by a mental health agency or a licensed private practitioner designated by the commissioner of mental health and substance abuse services to serve the court. If, during the pendency of any proceeding under this chapter, there is reason to believe that the child may have a developmental disability, the court may order the child to be evaluated on an outpatient basis by a mental health agency, developmental center, or a licensed private practitioner designated by the commissioner of mental health and substance abuse services to serve the court. The outpatient evaluation shall be completed no more than thirty (30) days after receipt of the order by the examining professionals. If needed, these laws would only affect the forensic psychologist in child custody evaluations. When referencing 36-6-106 (8), an evaluation only needs to be done if the parent's psychological state is in question. At that point, the forensic psychologist must be aware because, in instances like that, the parent in question may try to lie when answering specific questions to make themselves look better. When referencing 37-1-128 (E1A), we only perform evaluations if the child potentially has a mental illness. When a forensic psychologist is performing these evaluations making sure the child is comfortable could affect the evaluation. Some children are nervous when talking to someone unknown or new. Forensic psychologists must be calm, patient, and diligent during these child custody evaluations.
