M. Brennan September 25, 2023 PHI 227 Bio-Medical Ethics First Exam Review The first exam will take place on Canvas from Wednesday, September 27, through Monday, October 2. It will consist of two sections a short answer section (consisting of questions that can be answered in two to four sentences) and a long answer section (consisting of questions that can be answered in one or two paragraphs). To prepare for the exam, think about how you would answer the following questions: 1. Be able to identify one of the five basic principles of biomedical ethics we discussed in class and explain it. 2. Be able to provide a detailed explanation of one of the historical ethical failings we discussed in class, and be able to explain how one or more of the basic principles of biomedical ethics was violated in that case. 3. Be able to explain your views about the relative importance of the basic principles of biomedical ethics compared to one another. 4. What is a tort? 5. Be able to name one of the intentional torts identified by Fremgen as being relevant to medical professionals and give an example to explain how it applies. 6. What is the concept of ‘standard of care,’ and how is it applied in cases of negligence? 7. What are Good Samaritan Laws, and for what reason have they been implemented? 8. Be able to explain the legal concept of ‘ respondeat superior ’ and identify one of the duties an employee has to an employer according to this principle. 9. Be able to identify all of the elements required in order for a patient to provide informed consent. 10. Be able to explain the concept of paternalism in detail. 11. Be able to use one of the case studies we discussed in class to identify potentially paternalistic actions and explain how those actions are paternalistic. 12. Be able to explain your view on whether or not paternalism is justified in the case study you’ve selected. 13. Be able to explain the ‘Nurse’s Appeal to Conscience’ case study in detail and be able to explain how the nurse’s duty to the patient has come into conflict with her rights as a caregiver. Be able to also explain which principle has a higher priority in this case, in your view. 14. What qualifies as ‘protected health information’ under HIPAA? 15. What is a ‘permitted incidental disclosure’ under HIPAA, and why is such disclosure permitted? It might be helpful to come up with an example to illustrate your answer to this question. 16. What did the court rule in the Tarasoff v. Regents of the University of California case? 17. Be able to provide a detailed explanation of one of the case studies we discussed in class related to confidentiality. 18. Be able to identify the strongest reason for breaking confidentiality in the case you’ve chosen, and to identify the strongest reason for keeping confidentiality in the case. Also be able to explain whether or not you think confidentiality should be kept or broken in that case.
