Maria Bedolla CJCR2325 2/9/24 Lesson 4 Assignment 1. An inmate is angry about the actions of his caseworker and his shop supervisor. He believes their conduct is a direct result of a lawsuit that he has filed against prison staff. The inmate writes his mother, telling her that he is being retaliated against by prison staff. He says his caseworker is unfairly denying him better custody and the shop supervisor is giving him all the bad work details to do. Officer Smith, pursuant to agency policy, is reviewing the inmate’s outgoing letter. Can the officer stop the letter from being sent out, on the basis that institution security and good order are adversely affected? On any other grounds? a. If the inmate is only telling his mother that he is being retaliated, then this does not put the institution’s security and good order at risk. The officer has no grounds to stop the letter from being sent out to the inmates mother and once he finishes reviewing it, the officer needs to send it out. 2. Prison regulation prohibits inmates from receiving bulk rate mail. A Michigan inmate sues, saying that the prison regulation prohibiting free advertising materials, fliers, and other bulk-rate mail is unconstitutional under the First Amendment. The district court held for the inmate. The case was appealed to the Sixth Circuit, which applied the Turner standard. What was the finding of this appeals court? Sheets v. Moore, 97 F.3d 164 (6th Cir. 1996). a. The court granted a summary judgment to Sheets and awarded him $1 for nominal damages. The defendant was also instructed that they cannot reject Sheet’s mail based on the basis that what he is receiving is free advertising and other bulk mail. 3. How do you define religion and religious belief? At what point would (or should) a life practice become a sincerely held religious belief? As an example, can a Catholic (or follower of Islam or Judaism or any other religion) unilaterally, and at any time, claim that his or her religious beliefs require a vegetarian diet? a. Religion is defined as “a personal set or institutionalized system of religious attitudes, beliefs, and practices.” (Merriam-Webster) A religious belief or practice should be held if the inmate can prove that the religion requires them to follow a vegetarian diet. For example, it is well known that Jewish practices require that anyone who is Jewish to have a strict diet and only eat kosher meals. An inmate’s word should not be enough as they should have to proof with facts and documents that their religion requires them to practice what they are trying to do.
