Limited Governmental Powers The United States Constitution is a document that ensure that the American people are able to live freely and show the citizens that there are rights that they are entitled to and cannot be taken away. The first amendment states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances”. (The bill of rights: A transcription) Explain the details of your selected case or incident, discussing the specific constitutional infringements involved. Artis Lorie Smith is an artist that is strong within her faith, and she only likes to create content that is consistent with her faith. Lorie creates original content about her understanding of marriage. The Colorado Anti-Discrimination Act (CADO) however, requires her to create content that celebrates same sex marriage. This which does not line up with her beliefs. I believe that Lorie’s unalienable rights and her first amendment to be exact are being infringed in which case she cannot freely exercise her religion. The CADO is trying to impose a public accommodation law in order to make Lorie create the content that they are requiring. That is not an act of a democratic government, that is the equivalent of a communist act on the governments people. The state should not allow this to happen and if it does, then hopefully the federal government would be able to reach out and ensure that all parties are held responsible for these infringements of the constitution. Mankind was created in the image of God as stated in “Genesis 1:26” therefore we were given the gift of freedom of choice. “Because God has given that right to us, we owe that to each other, as well”. (CompellingTruth) Explain how the case ruling (or potential ruling) reinforces or weakens constitutional rights.
If the CADO forces Lorie to engage in acts that blatantly violate her religious beliefs, then what is the point of the constitution in the first place? The US Constitution is a living document that can be amended; however, you can’t just disregard a citizen’s unalienable rights of free speech and the right to exercise their religion in a professional manner. This would weaken the constitutional rights by showing the citizens around that although there is a document that allows you to do certain things in this world, the state and or federal government can take those rights away from you whenever they feel like it.
