I am emailing to confirm the requirements that would be needed in handling this
matter.
I confirm that the firm has been asked to investigate, whether it’s likely that Mr. Jack
Phillips would be found guilty of sexual harassment against our client Ms. Robin
Sliver.
I have also attached copy of my memorandum setting out the results of my legal
research.
In this matter it is likely a court would consider Ms. Robin Sliver was sexually
harassed by Mr. Jack Phillips on countless times.
In summary the facts provided by the client are:
Harassed by Mr. Jack Phillips over past months.
Mr. Jack Phillips sends Samantha sexually suggestive emails and propositions
by sending explicit pictures with inappropriate accompanying text messages.
Also, our client’s Screen Saver - the head was changed to client Ms. Robin
head on exotic dancer body This made our client feel uncomfortable and
embarrassed. Particularly due to Mr. Jack Phillips laughing at this- when left
computer.
Colleagues that were standing behind our client Ms. Robin Head saw the
screen saver also laughed out loud and commented also.
Under
s 28A of the Sex Discrimination Act 1984 (cth)
. defines sexual harassment to
be when
a person makes an unwelcome sexual advance, an unwelcome request for
sexual favours, or engages in other unwelcome conduct of a sexual nature in relation
to a person.
It is likely these actions by Mr. Phillips would be defined as sexual harassment
pursuant to the legislation.
Additionally, the case of
Richardson v Oracle Corporation Australia Pty Limited
.
provides some guidance regarding sexual harassment in the workplace.
Given that the court did find in favour of the applicant in that case – it is likely the
court would find in favor of our client.
It is likely the court would find that Ms. Robin Sliver was repeatedly sexual harassed
by Mr. Phillips this give favorable grounds for our client’s case.
