Dear HR: I just transferred to the Texas branch. Can my employer reduce the number of
hours I work based on the state Fair Labor Standards Act (FLSA) laws?

(FLSA). All 50 states in the US are at-will states. This means that it is within their right to
modify any terms they want for employment. This includes allowing the employer to reduce the
employees hours and schedule them when they want. This can be really frustrating and I am

Dear HR: I’m an hourly worker. If my shift is only six hours, how many breaks am I
allowed to have according to the federal FLSA laws?
Hello: Thanks so much for reaching out with your questions regarding breaks. According to the
FLSA laws do not require lunch breaks or short breaks throughout the shift. Employees who
offer breaks are usually twice a shift anywhere from 5 to 20 minutes. Typically if an employer
offers breaks they are paid as they are part of your work hours but when it comes to lunch break
they are not paid. Please let me know if you have any more questions or concerns.
Dear HR: I am a supervisor, and I always work more than eight hours a day. Am I
supposed to receive overtime according to federal FLSA laws? If not, why?
Hello: Thanks so much for reaching out with your question regarding overtime. According to the
FLSA laws, non exempt employees will receive overtime but exempt employees will not. FOr an
employee to receive overtime they have to go over 40 hours a week, once they have reached that
they will get paid time in a half for every hour over that 40 hour work week. Please let me know
