Project 3 Tort Law
Tort law is law surrounding intentional, neglectful, or Reckless acts that cause individuals
entities Unlawful harm. This refers to wrongful doing and wrongful neglect that specifically
impacts business and business deals. These acts, or tort, may involve anything from Trade
Secrets to theft to false identifying factors and disparaging statements. (Mcplegal, 2022). The
different types of torts, when relating to business law, are intentional torts, negligent torts, and
liability torts. Intentional torts are legal action when an individual claims something was done on
purpose with specific consequences to happen (Kubasek et al., 2020). Negligent torts occur when
the defendant acts in a way that causes harm to someone in a careless manner. Liability torts are
when the defendant is someone extremely dangerous and cannot be contained in a safe manner,
no matter the precautions in place
(Kubasek et al., 2020).
In regards to the scenario, The Friendly Dawg is responsible for committing a negligent
tort for not having the proper containment and proper care of live animals (such as snakes and
other animals on the premises). Without the proper containment, the snake got loose and inflicted
medical damage on the Sunshine Yoga studio’s owner in regards to a heart attack. The negligence
occurred when the owner of The Friendly Dawg purchased live snakes without purchasing or
renovating the proper containment of an enclosure, in addition to sealing holes in the event an
animal under his ownership got loose in adjoining businesses.
In terms of a lawsuit, Sunshine Yoga studio can file a negligent tort lawsuit against The
Friendly Dawg pet shop and their landlord, Mr. Lou. The lawsuit can consist of payment for
emotional damages, hospital bills and any other medical issues that arose as a result of the
incident, in addition to any physical damages to Ms. Jasmine's own property or the property of
sunshine yoga studios. The lawsuit against landlord Mr. Lou could be on the grounds of
negligent behavior; with Mr. Lou being aware of live animals and the renovation occurring, he is
also held responsible for not making Ms. Jasmine aware and responsible for any damages that
occurred in the situation that was discussed about a snake getting loose.
