Even though Joe and Janice called repeatedly, they could not reach their friends. Assignment 11 1. What are the basic rules concerning subject–verb agreement, proper verb tense, and noun– pronoun agreement? Subject-verb: Two or more subjects joined by and usually require a plural verb. Two or more subjects joined by or or nor require a verb that agrees with the subject closest to the verb. Most indefinite pronouns require singular verbs. Indefinite pronouns are pronouns that do not refer to a specific person or thing such as anyone, everybody, nobody, someone, and something. Whether a collective noun requires a singular or plural verb depends on the function of the collective noun. Verb Tense: When presenting your position or legal analysis, use the present tense. When addressing a court opinion that has already been decided, use the past tense. Noun-pronoun: Pronouns must agree with their antecedents. Antecedents joined by “and” require a plural pronoun. Assignment 13 Correct these sentences by properly using commas, semicolons, and apostrophes. 1. The attorney’s fees were disputed. 2. The long-complicated statutes were hard to understand. 3. The statute requires the witnesses to be present when the testator signs the will, and the witnesses must be in the same room with the testator, not in a separate room, and watch the testator sign the will. The statute requires the witnesses to follow multiple rules; For Example, to be present when the testator signs the will, be in the same room with the testator, and watch the testator sign the will. The sentence was too long so I added a semicolon and made it flow better. I had an independent clause that I joined with a conjunctive adverb. 2. Mary reached the conclusion that she had made a mistake. Mary had reached the conclusion, that she had made a mistake. The first part of the sentence is an introductory phrase and needs a comma to separate it from the last part of the sentence. 3. A relative pronoun requires a verb which agrees with its antecedent. A relative pronoun requires a verb that agrees with its antecedent. I changed “which” to “that” because there was a pronoun problem. I needed to change to have a subject-verb agreement. 4. Either the cousins or Darryl are going to the party. Either the cousins or Darryl is going to the party. This sentence needed “is” instead of “are” because it is placed right after Darryl’s name. If it was after the cousins name it would be “are” because it would be plural. 5. Sara, after giving careful consideration to the matter, reached the conclusion that she should buy the business. After giving careful consideration to the matter, Sara, reached the conclusion that she should buy the business. It makes more sense to put Sara’s name in the middle of the action and put commas on both sides of her name. 6. He decided to thoroughly and completely test the theory. He decided to test the theory completely. It makes more sense to take out either thoroughly or completely because the mean the same thing.

I needed to add commas around “nor steve”. 8. The statute requires stockholder approval for merger but it does not require approval for multiple real estate purchases. The key executives (president, secretary, and treasurer) are required to attend the board meeting. The key executives (president, secretary, and treasurer) are required to attend the board meeting. There shouldn't be a comma in front of parentheses. 10. The corporation statute requires: an annual board of directors meeting, an annual shareholder meeting, and the filing of an annual report. Chapter 14 The court’s instructions to the respondent are: to refrain from contacting the plaintiff in person, by telephone, or by mail; to pay monthly child support, and to perform one hundred hours of community service. The court’s instructions to the respondent are the following: to refrain from contacting the plaintiff in person, by telephone, or by mail; to pay monthly child support; and to perform one hundred hours of community service. The following statutes govern the issue, section 29-9-516, section 29-9-517, and section 29-9- 544. The following statutes govern the issue: section 29-9-516; section 29-9-517; and section 29-9- 544. Assignment 16 Correct the paragraphs presented in part A and part B. Use the proofreading checklist presented in Exhibit 14-4 . Part A: The government’s first witness at Bean’s sentencing was the DEA Task Force Officer Tony Silva. He testifies that in his debriefing Luiz had told him about four separate marijuana “grows” in which Luiz had participated. The first was in 1986 in Tress, Texas that produced 700 marijuana plants. The second was in 1987 in the Tonto wilderness, and it produced approximately 1500 marijuana plants. The third “grow” was in 1988 in Sies , Colorado , and they produced approximately 900 marijuana plants. The final “grow” was in 1991, also at the Sies site. Before the plants in this grow had been harvested, a Colorado State Police aircraft was spotted doing a “flyover” of the property. This prompted Luiz to destroy the crop making only fifty-two plants seized. As they were seized the officers noted that two or three plants were in a single grow site. Approximately 1,000 “grow holes,” with sprinkler heads connected to an extensive irrigation system, were found. Another one thousand uninstalled sprinkler heads, two water tanks , and fertilizer also was found on the property. Part B: The trial court sentenced Smith well within the statutory limits. Therefore the sentence is legal. The record thoroughly, clearly , and positively shows that Smith and his attorney have ample time to thoroughly review Smith’s sentence report before sentencing. They did so and ha d “no problems with it.” It is shown by the record that Smith never appealed his conviction or sentence. His section 2255 Motion was his first and only attempt to challenge his sentence. Any objections to the sentence report as submitted were waived by Smith. The defendant has the responsibility to advise the Court of any claimed errors in the sentence report. His failure to voice any objections waived any issue not properly presented. It has been long held by this court that “Section 2255 is not available to test the legality of matters which should have been raised on appeal.” Unless good cause can be shown why a defendant did not appeal or raise a particular issue on appeal , the defendant is barred from raising that issue in a section 2255 Motion.
