She calls you Friday afternoon to tell you that her doctor has not cleared her to return to work yet. You know that she has used up all of her FMLA and all accumulated paid time off. Can you fire Susan? No, you cannot immediately fire Susan in this described scenario. Susan’s leave was under the Family and Medical Leave Act (FMLA) which protects employees such as herself from termination when taking FMLA leave. A member of HR would need to follow the proper employment laws, and regulations such as reviewing if Susan’s illness meets the qualifications as a disability under the Americans with Disability Act (ADA), as well as rule out other reasonable accommodations before considering the termination of Susan’s duties.
