HIST 110 Supreme Court Template Mr. Kennedy Please answer in complete sentences. 1. State the issue before the Supreme Court in this case. Homer Plessy hoped to get the attention of the Supreme Court, so he boarded an all-white train as an African American. His civil rights group requested he board the train because he could have passed as a white man. They needed a conductor on the train to be in on the scandal. When asked by the conductor, Plessy agreed to being colored and was arrested and charged with violating the separate car act when he refused to go back to the color car. Plessy and his group hoped to address the “separate but equal” idea of segregation as he and many others believed the statement itself was a contradiction, and therefore, not actually equal. 2. What facts of the case were presented to the Court? The most important fact presented in his case was that the separate but equal idea violated 13 th and 14 th Amendment rights. The 13 th Amendment abolished slavery and would not hold up in court as separate cars did not relate to involuntary slavery. The 14 th Amendment stated all people born in the United States had the right to life, liberty, and property and equal protection under the law. This also would not hold up in court as the separate car act did not pose unequal conditions on colored and white people, it simply stated each race must report to their own separate cars.
3. What was the decision of the Court? What was the rationale behind it? Plessy plead not guilty to his charges but was charged anyways. He appealed with his 13 th and 14 th Amendment Rights argument where the state Supreme Court agreed with the original conviction. Plessy asked for his case to be heard by the U.S Supreme Court where the Justices (eight white men) ruled against Plessy 7-1 declaring, “Our constitution is color blind.” This decision would stand until 58 years later when Brown v. Board of Education occurred. 4. What was the effect of the decision? This decision defined the Jim Crow Era which would last 58 years. In these years, people of color were discriminated against in more than just train cars. They attended different schools, used different water fountains and bathrooms, went to different theaters, and so on. The end to this Era came in the Brown v. Board of Education decision that separate but equal was indeed not equal.
