Writing Your Case Brief
Bethel School District No. 403 v. Fraser
Facts:
March 3, 1986, a case was argued about Matthew Fraser and a speech he made during a school assembly that was intended to nominate his friend for an elective office position at school. During the speech, Matthew Fraser made some metaphors that were of a graphic and sexual nature. As a result of the metaphors used by Matthew Fraser, he was given a 2-day suspension because of the school disciplinary code which includes obscene, profane language and gestures.
Legal issue:
The Legal issue is does the disciplinary action taken by the school violate Matthew Frasier's First Amendment rights of free speech, with their disciplinary code.
Court's decision:
The Supreme Court decided in a 7-2 vote that Bethel School District No.403 did not violate the First Amendment. The court found the punishment given by the school was appropriate to prohibit profanity and offensive language “Burger concluded that the First Amendment did not prohibit schools from prohibiting vulgar and lewd speech since such discourse was inconsistent with the "fundamental values of public-school education."
