Kelly did not complete a feasibility study for a Sunset Key residence, though he reported to the client that he had. This was in violation of Section 471.033(1)(g), Florida Statutes, and Rule 61G15-19.001(4), Florida Administrative Code, negligence in the practice of engineering. Penalties included a Reprimand, a fine of $5,000, cost of $1326.20, successful completion of the Board’s Study Guide within 90 days, and successful completion of an online professional ethics course within 90 days. To prevent a situation like that of Michael F. Kelly, who failed to complete a feasibility study but incorrectly reported his situation to a client, engineering ethics and regulations must be emphasized and adhered to. One of the main ways to avoid such ethical lapses is to prioritize honesty and transparency in professional practice. Engineers should strive to provide accurate, truthful information to clients and avoid misrepresenting their work or completing basic tasks such as feasibility studies. Additionally, adhering to the Code of Engineering Ethics is critical.
