2 Fundamental Legal Considerations Analysis Trucking business is the type of business I plan on going into or starting. We will be hauling freight for mainly small businesses but not limited to small businesses from coast to coast or state to state. We will also have a warehouse to store and hold freight for future shipments. Our warehouse will be in place to provide proper storage for those companies to be able to store and extend the lifespan of their products. We will have a control temperature side along with a side for dry products to weather protect them if needed. By networking, I have found that a lot of products are being wasted because of the companies not having proper storage. The leg; structure that we will be running or registered under is LLC which stands for Limited Liability Corporation. Having an LLC will allow us to separate our assets from our business assets. It will also make things on both sides easier to manage. We also will start working out of a home office with our warehouse on a different site with management on site as well to track the going and coming. They will also keep an inventory of everything being stored. We will also have parking for our trucks and room for them to move in and out safely. Our company‘s liabilities will consist of or carry the risk of our employees and trucks and the operation of the warehouse. We will also have the liability of the products being stored in the warehouse and the transporting of them from one location to another location. We will need to function properly as a business is the permits mandated by the state. We will also have to make sure our employees have the proper licenses to drive and operate our vehicles to DOT standards and our own. We will also have to make sure we have enough insurance to cover everything from the products to the employees in case something happens. Environmental regulations a what we are going to have to follow having a warehouse with different types of products. Depending on what we are storing we have to make sure nothing is being contaminated. On the trucking side, we are going to have to follow FMCSA regulations to make sure we are within their guidelines. Some the FMCSA guidelines that we will have to follow are listed below. Semitrailer  means a trailer, except a pole trailer, so constructed that a substantial part of its weight rests upon or is carried by another motor vehicle. Truck  means a motor vehicle with motive power, except a trailer, designed primarily for the
3 transportation of property or special purpose equipment.  Truck tractor  means a truck designed primarily for drawing other motor vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and the load so drawn.  Unloaded vehicle weight  means the weight of a vehicle with maximum capacity of all fluids necessary for operation of the vehicle, but without cargo, occupants, or accessories that are ordinarily removed from the vehicle when they are not in use. Some of the environmental regulations I would have to follow are listed below. On April 12, 2023, EPA announced a proposal for more stringent standards to reduce greenhouse gas emissions from heavy-duty (HD) vehicles beginning in model year (MY) 2027. The new standards would be applicable to HD vocational vehicles (such as delivery trucks, refuse haulers, public utility trucks, transit, shuttle, school buses, etc.) and tractors (such as day cabs and sleeper cabs on tractor-trailer trucks). Specifically, EPA is proposing stronger CO 2  standards for MY 2027 HD vehicles that go beyond the current standards that apply under the  HD Phase 2 Greenhouse Gas program . EPA is also is proposing an additional set of CO 2  standards for HD vehicles that would begin to apply in MY 2028, with progressively lower standards each model year through 2032. This proposed “Phase 3” greenhouse gas program maintains the flexible structure created in EPA’s Phase 2 greenhouse gas program, which is designed to reflect the diverse nature of the heavy-duty industry. As part of this action, EPA also is proposing to revise its regulations addressing preemption of state regulation of locomotives.
