Acheson Hotels, LLC v. Laufer
Deborah Laufer is a self-appointed “tester” of public accommodations to determine
whether they are compliant with the Americans with Disabilities Act (ADA). The ADA requires
that hotels provide information about the accessibility features the hotel has in place regardless
of the format of booking so that individuals with disabilities know before they arrive if they will
have the accommodations they need if they stay at the hotel. Laufer searches hotel websites for
whether the information about accessible accommodations are included on the website. If a
hotel’s website lacks this information, Laufer seeks an injunction to require the information to be
added and sues the hotel for her attorney’s fees. In the present case, Acheson Hotels, LLC was
one of the hotels targeted by Laufer. Acheson Hotels, LLC contends that the Laufer lacks standing as she has no intention of
accessing the hotel, so there is no particularized and concrete injury as required under Lujan v.
Defenders of Wildlife. Laufer in turn claims that where information is not provided on reservation websites, no
individual pursuing imminent travel with accommodation needs can benefit from the injunction
process allowed under Title III of the Americans with Disabilities Act. She claims that the only
way to ensure compliance that is vital for such travel is through “tester” suits like that one that
